Man Facing 50+ Counts of Child Porn Crimes
Many people take advantage of children in sexual ways. This is illegal, but it happens often. In fact, a Florida man is facing 51 counts of child porn possession and distribution.
The 39-year-old man was arrested after an investigation showed he had secretly recorded a child taking a shower and then shared it on social media. The investigation was led by multiple agencies, including the Collier County Sheriff’s Office (CCSO), the Southwest Florida INTERCEPT Task Force, and the Internet Crimes Against Children Task Force.
According to the investigation, authorities found that the man was uploading and transmitting child porn to his Kick and MediaLab accounts. The images in the files depicted children ranging in age from infants to 6 years old. The children were engaged in lewd behavior or being sexually victimized by an adult.
The man was arrested on September 19 after police executed a search warrant at his home. The search turned up more images of suspected child sex abuse material on the man’s cell phone. The man is facing dozens of charges, including 45 counts of child pornography possession, three counts of in-state transmission of child porn, one count of video voyeurism on a child, one count of allowing a child to engage in sex, and one count of promotion of sexual performance by a child.
This case is still under investigation.
Sharing Child Porn
The man in this case is accused of sharing child porn on social media. Sharing child pornography is a much more serious offense than simple possession. This is because reproducing and distributing child pornography allows more people to see it and share it again. Criminal charges related to distributing child porn often result in stricter penalties than those associated with simply possessing this data for personal use.
Distribution of child porn is often done by sharing files through peer-to-peer-based networks. Even if you do not understand how these networks function, you can still be charged with child porn distribution offenses. If you have child porn images on your computer that can be accessed by others, you can still be charged with a crime even though you might not know that someone else is accessing the images from your computer.
The most commonly used defense for these cases involves the Fourth Amendment, which addresses illegal searches and seizures. If there is a search warrant, was there probable cause? This is something you will want to address with your lawyer.
